What the Two Nebraska Ballot Measures Would Do

Secretary of State Bob Evnen certified the Online Sports Wagering Authorization Constitutional Amendment and the Online Sports Wagering Regulation Initiative, his office said on August 21, 2026, as reported by 1011now (KOLN).

The amendment would change the Nebraska Constitution to allow laws authorizing internet-based sports wagering, while the separate statutory measure would set the rules for it. Nebraska Public Media reported that the regulatory measure would require wagering servers to sit inside Nebraska and limit each casino to no more than two online platforms, with those platforms answering to the Nebraska Racing and Gaming Commission.

The petition drive was run by the Tax Relief Nebraska campaign and sponsored by Jordan McGrain. The campaign followed years of failed efforts in the Legislature and McGrain chose to bypass lawmakers and go straight to voters. Under that plan, online sportsbooks would be tied to the state’s existing racetrack casinos and overseen by the Nebraska Racing and Gaming Commission, which the ballot measures direct to adopt rules on or before June 1, 2027 if voters approve.

What Happens Between Now and the Vote

The Nebraska Secretary of State’s office said it will hold public hearings on the ballot measures in each of Nebraska’s three congressional districts and publish an informational brochure, with dates and locations announced later. The office must certify the full 2026 general election ballot by September 11, 2026. Absent any legal challenge after certification, both questions go to voters on November 3, and each needs its own majority to pass because the two measures are designed to work together.
